This Agreement ("AGREEMENT") describes
the Terms and Conditions under which Sunrise Poker poker-room (Poker-room)
offers you (User) access to activities and games of the Poker-room
(Games) that are available through Poker-room's website (Site) located
at http://www.sunrise-poker.com
and its associated services.
THIS AGREEMENT AFFECTS YOUR
RIGHTS AND YOU SHOULD READ IT CAREFULLY. BY CLICKING THE "I AGREE"
BUTTON AT THE BOTTOM OF THIS DOCUMENT YOU ACCEPT THE TERMS AND CONDITIONS
OF THIS AGREEMENT SET FORTH BELOW. YOU ACKNOWLEDGE AND AGREE THAT
THIS AGREEMENT REPRESENTS THE ENTIRE AND SOLE AGREEMENT BETWEEN YOU
AND POKER-ROOM WITH RESPECT TO SITE AND GAME AND THAT THIS AGREEMENT
SUPERSEDES ALL PRIOR OR CONTEMPORANEOUS, CONFLICTING, OR ADDITIONAL
COMMUNICATIONS WHETHER WRITTEN, VERBAL OR ELECTRONIC BETWEEN YOU AND
POKER-ROOM WITH RESPECT TO SITE AND GAME.
A printed version of this agreement and
any communication given in electronic form shall be admissible in
judicial and administrative proceedings based upon or relating to
this agreement to the same extent and subject to the same conditions
as other business documents and records originally generated and
maintained in printed form.
1.
The Poker-room is restricted to individuals of legal age of majority
only. User cannot play under any circumstances if he/she has not reached
the age of 18 or the legal age of majority in his/her jurisdictions,
whichever is greater. MINORS ARE EXPRESSLY FORBIDDEN FROM PARTICIPATING
IN THE ACTIVITIES AND GAMES OF THE POKER-ROOM.
2.
Laws regarding gambling vary throughout the world and participation
in the activities and games of the Poker-room is open only to residents
of those jurisdictions where such participation is legal and not prohibited.
User certifies that he/she fully understands the standards and laws,
as such standards and laws relate to the Games, of the community/legal
jurisdiction where he/she is resident. User certifies that he/she
has the complete and unrestricted legal right to participate in the
Games. PARTICIPATION IN THE ACTIVITIES AND GAMES OF THE POKER-ROOM
IS VOID WHEREVER PROHIBITED BY LAW.

User is not required to participate in the Game and such participation,
if elected by User, is at User's sole option, discretion and risk.
4.
User understands that the Game is for entertainment value only. User
understands and acknowledges that no purchase is necessary or required
to play the Game. If a user wishes to play without betting money,
he/she may do so.
5.
User hereby certifies that his/her interest in the Game and the Site
is personal, and not professional. User's entering the Poker-room
is solely for User's own personal entertainment and any other entrance,
access, use or reuse of the Poker-room or the Site by User is strictly
prohibited.
6.
Employees of the Poker-room its licensees, distributors, wholesalers,
affiliates, subsidiaries, advertising, promotion or other agencies,
media partners, retailers and members of the immediate families of
each are not eligible to participate in the Game.
7.
Poker-room guarantees that personal identity and details of all Users
will remain confidential. User's details may be used for marketing
purposes only with User's express consent.
8.
Poker-room guarantees that wagering information will remain confidential.
Poker-room will not report wagering information on behalf of any user.
This is the sole responsibility of each user.
9.
User's account details are confidential and therefore no claims can
be made against User's account except claims of his/her immediate
relatives (heirs) if the User has deceased.
10.
Users are solely responsible for their account transactions
and should keep their account information and passwords confidential.
User shall not allow any other third person or third party including,
without limitation, any minor, to use or re-use User's account, access
and/or use any materials or information from Poker-room, accept any
prize, or participate in the game. The Poker-room shall not be required
to maintain user names or passwords and if User misplaces, forgets,
loses, or is otherwise unable to enter Poker-room because of anything
other than Poker-room error or should a user give away, share, or
lose his/her account number and/or password Poker-room will not be
held liable for any claims regarding that account.
11.
All wagers are final once accepted by Poker-room. Management will
investigate all transaction and wager errors and disputes. All Management
decisions are final and binding on parties involved.
12.
Management will monitor all wagers and account transactions. All transactions
and wagers are stored on Poker-room server. Should any errors or disputes
arise it is Poker-room server record and not User's personal computer
record that will be determinative and binding on parties involved.
13.
Poker-room shall not be held responsible for wager loss except as
provided by this Agreement. For instance, in case of main gaming server
error the User may lose the prize but not the wager.
14.
All wagers must be placed through the user interface provided by this
Poker-room on its Site. Any wagering through other means, including
the use of any electronic gambling aides, is strictly forbidden. In
the event that use of non-approved client software is detected, the
Management reserves the right to invalidate all such wagers retroactively,
cancel the User's account, or take any other appropriate action, including
administrative or criminal prosecution.
15.
Any wagers considered as fraudulent or that aim to defraud Poker-room
will be deemed invalid and User's account will be terminated and confiscated.
This condition equally applies to wagers by bookmakers, gaming syndicates,
and any other persons and entities if they pursue fraudulent aims.
16.
If the prize is awarded to User, Poker-room will issue the prize check.
Any applicable taxes and fees in connection with any awarded prize
are the sole responsibility of User. Prizes cannot be transferred,
substituted, or redeemed for any other prize.
17.
Any and all materials submitted for prize claims become the property
of the Poker-room and will not be returned.
18.
The Poker-room is not responsible for lost, late, illegible, incomplete,
damaged, mutilated, misdirected, or postage due mail, requests, Prize
claims or entries. Liability for materials of the Game containing
any error is limited to replacement.
19.
By accepting prize and/or winnings, User consents to use his/her name
for advertising and promotional purposes without additional compensation
except where prohibited by law. User, by acceptance of prize, acknowledges
compliance with all rules herein.
20.
Poker-room reserves the right to suspend or terminate any activity
or game with prior notice to the User.
21.
User is responsible for all transaction charges and expenses related
to transfer of funds from User to Poker-room.
22.
User's transaction expenses, i.e. charges for transfer of funds from
User to Poker-room, will be compensated in the form of bonus.
23.
Under no circumstances Poker-room will provide credit to User.
24.
Poker-room will not be responsible for any failure to perform any
obligation under this Agreement in following cases:

Any failure of the
gaming server or payment system to perform as intended;

The technological
or telecommunications failure of any third party;

Any act of terrorism,
civil unrest, war, or of God;

Any acts of governmental,
state, local, municipal or other authorities or any change in
governmental laws, regulations, or rules, including license
revocation;

Fire, explosion, flood,
or strike;
-
Any other unforeseeable
set of circumstances outside of Poker-room's reasonable control
25.
User shall hold the Poker-room, its employees, officers, directors,
licensees, distributors, wholesalers, affiliates, subsidiaries, advertising,
promotion or other agencies, media partners, agents and retailers
harmless and shall fully indemnify the same from any and all costs,
expenses, liabilities and damages whatsoever that may arise as a result
of User's:

Entry, use, or reuse
of the Site;

Use of any materials
at the Site;
-
Entry, use, or reuse
of the Poker-room server;
-
Participation in the
Game
-
The acceptance of
any Prize
-
Use or reuse of any
software either downloaded from the Site or acquired in other
ways and forms.
26.
Materials of the Game (whether electronically obtained or obtained
by other means) are automatically void if counterfeited, mutilated,
forged, altered or tampered with in any way, if illegible, mechanically
or electronically reproduced, obtained outside authorized legitimate
channels or if they contain printing, production, typographical, mechanical,
electronic or any other errors.
27.
User shall hold the Company, its employees, officers, directors, licensees,
distributors, wholesalers, affiliates, subsidiaries, advertising,
promotion or other agencies, media partners, agents and retailers
harmless and shall fully indemnify the same from any and all costs,
expenses, liabilities and damages whatsoever that may arise should
the gambling business in User's jurisdiction become or be pronounced
illegal and prohibited.
28.
User understands that the terms Sunrise Poker poker-room™ are the
trademarks, service marks, and trade names of the Poker-room and User
obtains no rights to such terms, nor any other terms, graphics, text,
concepts or methodologies, by using the Site and the material contained
therein, participating in the game or accepting the prize. The above
terms are property of Poker-room and are protected by international
copyright and intellectual property laws, treaties and agreements.
29.
Poker-room and User agree to abide by the Terms and Conditions of
this Agreement and agree not engage in any activities that violate
any of the provisions of this Agreement.
30.
The Poker-room makes no representations or warranties, implicit or
explicit, as to the legal right for User to participate in the Game
nor shall any of the Poker-room's employees, licensees, distributors,
wholesalers, affiliates, subsidiaries, advertising, promotion or other
agencies, media partners, agents or retailers have the authority to
make any such representations or warranties.
31.
All rules, regulations, and payoffs contained herein are subject to
change and revision by the Poker-room without prior written notice.
Any such changes or revisions will be posted at this website. It is
the User's responsibility to periodically review at a rate not less
than once monthly this Agreement posted at the Site.
32.
Poker-room reserves the right to refuse and/or close any account at
any time and for any reason whatsoever without prior notice to the
User. The account can also be terminated at any time at User's request.
33.
Any dispute arising out of or relating to the Games, prizes, Site,
client application, Poker-room, gaming software developer, and/or
payment processor shall be governed by the laws of the State of Anjouan,
excluding choice of law principles and you hereby consent to the exclusive
jurisdiction and venue of courts in the State of Anjouan.
